WORKSHOP TERMS AND CONDITIONS


This information is really important as it affects both Mèlisses and your legal rights, so please read it carefully and make sure to contact us in case you have any questions: we’ll be more than happy to assist you. You must agree to these Terms in Full to reserve your spot at a Mèlisses Workshop.

HOW TO REACH MÈLISSES

Thank you for choosing to attend a Mèlisses Workshop in Andros! The two nearest Airports are Athens and Mykonos. From Athens airport you can reach Rafina port by Taxi or Bus (20 minutes approx), then catch the ferry to the island of Andros (about two hours).
 Alternatively, you can take a ferry from Mykonos to Andros (about two and a half hours).
There are usually 2 different ferry rides per day. We encourage you to confirm your ferry tickets before proceeding with your flight bookings.

BOOKING

Bookings are made on a first-come, first-served basis and participation is only guaranteed once we are in receipt of full payment. Workshops and activities are designed for all participants alike, irrespective of level or ability. Cooking workshops especially cater to all levels of cooking ability and skill, from beginners to advanced. Minors under the age of 18 years must be accompanied by a paying adult.

Mèlisses reserves the right to accept, retain or refuse any person as a participant of any workshop, or to cancel any workshop if circumstances demand so. In the unlikely event that a workshop needs to be canceled, we will give you as much notice as possible and you will be offered the choice of an alternative workshop or a full refund of the workshop fee. However, we will not be liable for any other expenses that you may incur such as associated accommodation or travel itinerary.

The course descriptions are to be considered as a guide only. We reserve the right to alter the course content, ingredients used, date and time (within reason) if necessary. Please note that due to weather conditions on the island, or logistics reasons (market availability, seasonal variety etc), some activities may switch or change, but the main content of the workshop will be unaltered.

CANCELLATION POLICY AND REFUNDS

We regret that no refunds will be given for participant cancellation for any reason whatsoever. In the unfortunate event that you are unable to attend the workshop, somebody else may attend the workshop in your place, as long as we are informed about it and if it is more than 48 hours prior to the published class commencement time.

We are not responsible for any ferry/ other transportation strikes or severe weather conditions that prohibit you from reaching the island on time.

CERTIFICATION OF HEALTH

By making this payment, you certify that you do not have any condition or disability that would create a hazard or hardship for other Participants taking part to the workshop and that you understand that health-care standards, facilities, and services in Greece may be different or inadequate for treatment of certain health conditions. Mèlisses makes no representations or warranties or disclaimers regarding special accommodations or handicap accessibility on any program. Mèlisses reserves the right to decline accepting or to retain any Participant whose health or actions in Mèlisses’ sole judgment will impede the operation of a workshop or activity or the welfare or enjoyment of fellow Participants. Participants hereby acknowledge and agree that the Workshop may involve long commuting distances between accommodations; lack of privacy in accommodations; restrictions on heating and/or water usage; lack of air conditioning; lack of a smoke-free environment; lack of easy access or no access to word processing and/or electronic mail; and/or Internet connection and/or unfamiliar food.

FOOD ALLERGIES

If you have any medical and/or food allergies, you agree to notify us in writing in the fields provided below to and discuss this with us prior to attending any workshop. You are solely responsible for: (i) informing Mèlisses if you have; and (ii) avoiding any contact with such medical and/or food allergies. Mèlisses may attempt, but cannot guarantee, to accommodate your allergies or dietary habits. It is your responsibility to prevent allergic reactions.

CLOTHING

You should be dressed comfortably but with safety in mind. For Cooking Workshops flip-flops and open-toed shoes are not permitted in the kitchen. Do not wear loose clothing that could get caught in machinery or equipment. Jewellery should not be worn. You should wear hair clips or bands for long hair.

CONSENT FORM, ASSUMPTION OF RISK, WAIVER AND RELEASE

As a condition of and in consideration of Mèlisses workshop allowing you to participate in one of its workshops, you agree as follows:

I fully understand and acknowledge that:

(A) the workshops I am registering to take part in are designed for the purpose of improving personal skills such as cooking, photography, food styling etc. and also to discover and explore the island of Andros Greece. These activities may remotely put you in contact with certain risks such as: injuries, bleeding, bug bites, poisonous snake bites, slipping, falling, etc. During the course of the Workshop and as an integral part of it, outings will be made to selected locations in the island of Andros and all participants will be driven around the island of Andros in 4x4 cars. The island of Andros is a big island and occasionally some of the outings may require 20 to 50 minutes driving.

(B) Especially for cooking workshops, as with all cooking activities, certain risks and dangers arise, not all of which can be described herein, but may include, without limitation, cuts, scrapes, scratches, puncture wounds, thermal burns, chemical burns, scalds, injuries from using cooking equipment and instruments, eye injuries or irritation, skin irritations, allergic reactions, food poisoning, slips, falls, and choking. I have read the aforementioned risks and I am familiar with the nature of the workshops and activities involved in the cooking workshop. I understand and appreciate the inherent risks and the types of injuries that may occur as a result of my participation. I assert that my participation in Mèlisses workshops or activities is voluntary and I knowingly assume all risks associated therewith.

(C) I understand that I am ultimately responsible for maintaining the quality of the food I prepare, cook and eat during any workshop or after any class;

(D) as stated under (A) my participation in the workshops may result in injury, illness or harm to me or others these risks and dangers may be caused by the negligence of the operators, owners, employees, officers, representatives or agents of Mèlisses , the negligence of the other participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes;

(E) by participating in the workshops, I assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence, acts or omissions or other conduct of the owners, agents, officers, representatives or employees of Mèlisses Andros, or by any other person ;

(F) I am fully aware that the location where the workshop is taking place is in a steep area of the Island of Andros, with rocky terrain and potentially dangerous cliffs surrounding the property. Although the property of Mèlisses (accommodation area and workshop area) is protected, walking inside the property must be done wearing suitable shoes (rocky terrain and stairs, danger of slipping) and walking beyond the property is only allowed upon participants own responsibility and risk. Mèlisses strongly advises against wandering off the property grounds (danger of falling, steep cliffs, snakes, scorpions, rocky sea etc.) and assumes no responsibility in case of injury or death of the participant;

(G) The use of the private swimming pools is prohibited to minors under 18 years old without a parent/adult supervisor. The use of swimming pools is allowed only at participants’ own risk and Mèlisses bears no responsibility, for any event of injury, including drowning or death as a result of the use of the swimming pools.

Furthermore, in consideration of my ability to participate in a workshop or activity, on behalf of myself, my personal representatives and my heirs, I hereby voluntarily release, waive, discharge, hold harmless, and agree to defend and indemnify Mèlisses members, managers, officers, directors, chefs, employees, attorneys, agents, and assigns (collectively, the “Released Parties”), from and against any and all demands, claims, losses, injury, damages, liability, attorney fees, costs, and/or expenses of litigation, in law, whether known or unknown, that have arisen or may arise from my participation in or attendance at any workshop or activities or outings provided by Mèlisses, or from my use of any recipe, skill, technique, or method learned from Mèlisses or in any of Mèlisses’s workshops or activities. Furthermore, I promise not to sue any of the Released Parties for such demands, claims, or liability.

PRIVACY-GDPR (GENERAL DATA PROTECTION REGULATION)

I understand that Mèlisses retains the right to take photographic or film records of any of the workshops, and I agree that Mèlisses may use any such photographic or film records for promotional and/or commercial purposes without any payment or consideration to me or my personal representatives or heirs. I hereby consent and assign all rights, titles and interests I may have in or to any media in which my name or likeness might be used to Mèlisses and I waive any and all associated moral rights I may have in any such photographs or film records. I hereby consent and grant the right to Mèlisses to store/use my personal data collected for logistic, statistical purposes and for future notifications and/or promotional material.

COPYRIGHT AND INTELLECTUAL PROPERTY RIGHTS

All copyright and other intellectual property rights relating to any course material and handouts provided in connection with the workshop will remain the sole property of Mèlisses. No part of any course material may be copied or translated in any form without the prior written consent of Mèlisses.

TRAVEL ARRANGEMENTS AND DOCUMENTS

It is your responsibility to obtain and carry a valid passport, visa(s) (if necessary), and any other documents required by applicable government regulations. Non EU residents may require special travel documents. Check with your local embassy or consulate. Participants hereby acknowledge and agree that Mèlisses or its personnel does not represent or act as an agent for, and cannot control the acts or omissions of any transportation carrier, hotel, tour organiser or other provider of food, goods or services involved in the Workshop. Participants hereby acknowledge and agree that Mèlisses is not responsible for matters that are beyond its control, and that Mèlisses personnel cannot warrant the safety or convenience of the circumstances under which The Participant will be living or travelling. The Participant hereby acknowledges and agrees that it is within its sole and exclusive discretion to change travel, accommodations, and other arrangements as it deems necessary.

GOVERNING LAW

The venue of any dispute between the parties that may arise out of this agreement or otherwise shall be the laws of the Hellenic Republic and Greek Courts are agreed as competent. The official exact translation in the Greek Language of this document is agreed by the Participant as the prevailing version for use in the Greek Courts if necessary.
